Privacy Policy

1. Introduction

1.1 FanDuel (“FanDuel, we, us”) understands that individuals who access FanDuel’s Service (“you” or “users”) care about how their privacy is handled. This Privacy Policy sets out important information about how we collect, use and disclose of personal information processed through FanDuel’s sports betting and iGaming websites located at https://fanduel-login.ca/ (collectively, the “Site”), the associated mobile application, and any other features, tools, content, or related services made available from time to time by FanDuel (the “Service”). FanDuel provides this Privacy Policy so you can make an informed choice about whether to use or keep using the Service.

This Site and the Service are being offered by FanDuel as part of the open and regulated iGaming market conducted and managed by iGaming Ontario (http://fanduel-login.ca/). In the course of providing the services (i) FanDuel collects, uses and discloses personal information on behalf of and as agent to iGaming Ontario; and (ii) FanDuel collects personal information in accordance with Freedom of Information and Protection of Privacy Act (“FIPPA”) and other applicable privacy laws, and under the authority of Ontario Regulation 722/21 made under the Alcohol and Gaming Commission, and the operating agreement entered into between FanDuel and iGaming Ontario.

1.2 This Privacy Policy should be reviewed together with our Terms of Use . When you access the Service, you acknowledge and agree that your personal information may be collected, used and otherwise handled according to the practices outlined in this Privacy Policy. “Personal information” means information about an identifiable individual and includes any information that constitutes personal information within the meaning of FIPPA and other applicable privacy laws.

1.3 Your access to and use of the Service and any information you provide through the Service continues to be governed by the terms of this Privacy Policy and our Terms of Use, as each may be revised from time to time.

iGaming Ontario offers a voluntary centralized self-exclusion tool (“BetGuard”) whereby individuals may register to centrally self-exclude from all regulated igaming sites in Ontario. BetGuard is offered subject to the BetGuard privacy policy.

In relation to BetGuard, iGaming Ontario, FanDuel, and their respective authorized suppliers on behalf of iGaming Ontario, may collect, use, share, disclose, retain, or otherwise handle your Personal Information to develop, operate, maintain, sustain, update and modify BetGuard. This information may be used for verifying your identity and centralized self-exclusion status, enable your centralized self exclusion from regulated igaming sites, or for any other lawful purpose under the BetGuard privacy policy and the BetGuard terms and conditions. Personal Information will be retained only for the period allowed by the BetGuard privacy policy and Applicable Law.

2. Information We Collect

2.1 When you use our Service and submit information to us through that use, this Privacy Policy applies. You give certain personal information to FanDuel when you choose to take part in different activities available through the Service such as registering for an account, placing wagers, posting messages, using promotions, responding to surveys or joining newsletters or other mailing lists.

We take reasonable measures to help ensure we do not collect personal information from anyone under the age of 19. If a parent or guardian learns that his or her child under the age of 19 has submitted information to us, the parent or guardian may contact us at the details set out below in the “Changes and Updates” section to have such personal information deleted.

The personal information we collect from you may generally include:

2.1.1 your full name;

2.1.2 email address;

2.1.3 date of birth;

2.1.4 PayPal, bank account or credit card billing information;

2.1.5 username;

2.1.6 descriptive occupation (i.e., job position and industry);

2.1.7 your preferences;

2.1.8 if you choose to participate, submissions to various promotions;

2.1.9 responses to surveys;

2.1.10 communications sent to us by you;

2.1.11 your subscriptions to newsletters and services offered by us; and

2.1.12 location-based information. Our Service uses location-based services in order to locate you so we may verify your location to ensure compliance with legal and regulatory requirements.

2.2 In addition to the information above, we will need verifying your identity so that you can use some aspects of the Service. For these purposes we (or our third-party verification provider) may verify your identity with a credit bureau and access your credit file (only for identification verification and not as a credit check). This will not impact your credit score. We (or our third-party verification provider) may also verify your identity with your mobile phone provider. We may also request the following personal information from you (for compliance purposes, provision of this information, when requested, may be required to use our Service):

2.2.1 passport information;

2.2.2 drivers license information;

2.2.3 permanent and temporary address;

2.2.4 tax-related information;

2.2.5 other identification documents, such as, a utility statement, bank statement, or marriage license, and the number associated with that information; and

2.2.6 other information as may be needed to verify you under applicable laws and regulations

2.3 We will collect certain of the above personal information, and if provided by you, your country of residence, business telephone number, employer’s name, employer’s address, citizenship, and alias/preferred name for the purposes of complying with our anti-money laundering obligations under applicable law.

2.3.1 If you attest that you are a Politically Exposed Person (“PEP”) the Head of an International Organization (“HIO”), or a family member or a close associate of a PEP or HIO, as those terms are defined in the Terms and Conditions, you will be required to provide additional information such as your source of funds, your source of wealth, the nature of your connection to the PEP or HIO if you are a family member or close associate of a PEP or HIO, the office or position of the PEP/HIO, the PEP or HIO organization/institution name and, if you are a family member or close associate of a PEP or HIO, the nature of the relationship between the family member and close associate of the PEP or HIO. Such information is processed through behalf of iGaming Ontario and may be shared with other Operators as part of enterprise level player monitoring.

2.4 Along with any Personal Information or other information that you decide to provide to us via our Service, we and our third-party service providers may rely on different technologies that automatically or passively store or collect certain information when you visit or interact with the Service (“ Usage Information”). This Usage Information may be stored or accessed using a variety of technologies that may be placed on your personal computer, browser, laptop, tablet, mobile phone or other device (a “ Device”) when you visit or interact with our Service. When your Device connects to our web servers (for example, when you visit this Service or view an HTML e-mail), our web servers automatically collect Usage Information. We also may determine the applicable technology available in order to serve you the most appropriate version of a web page, e-mail, advertising or promotional announcement or similar service. Where we connect Usage Information with your Personal Information that we collect directly from you on the Service, we will handle it as Personal Information.

2.4.1 Usage Information may include:

· your IP address, UDID or other unique identifier (“ Device Identifier”). A Device Identifier is a number that is automatically assigned to your Device used to access the Service, and our computers identify your Device by its Device Identifier;

· your Device functionality (including browser type, operating system, hardware, mobile network information);

· the areas of our Service that you access and your activities there, including remembering you and your preferences;

· your Device location;

· your Device characteristics; and

other Device data, including the time of day, referrer data that identifies the web page visited prior and subsequent to visiting our Services among other information.

2.5 Cookies Information: When you access the Site, we may send one or more cookies – small files – to your Device, which may allow us or others to identify your browser uniquely. FanDuel uses both session cookies and persistent cookies. A persistent cookie stays after you close your browser. Persistent cookies may be used by your browser on subsequent visits to the Site. Persistent cookies can be removed by using your web browser help file directions. Session cookies are temporary and usually disappear once you close your browser. You may be able to reset your web browser to refuse all cookies or to indicate when a cookie is being sent. However, some features of the Site or Service may not work properly if cookie acceptance is turned off. If you do not wish to receive a cookie, you may set your browser not to accept cookies. Please note, however, that if you choose not to accept cookies from our website, this may affect the operation of certain features of our Site and your ability to perform certain transactions or access certain content.

2.6 Log File Information: When you use our Service, our servers may automatically log certain information that your Device sends whenever you visit any website and use certain apps. These server logs may include information such as your web or app request, Internet Protocol (“IP”) address, browser type, browser language, referring/exit pages and URLs, platform type, UDID or other unique identifier (“Device Identifier”), your Device functionality (including browser type, operating system, hardware, mobile network information, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, the date and time of your request, and one or more cookies that may uniquely identify your browser.

2.7 Clear GIFs Information: When you use our Service, we may employ technology such as “clear GIFs” (a.k.a. Web Beacons) used to track the online usage patterns of our users. In addition, we may also use clear GIFs in HTML-based emails sent to our users to track which emails have been opened by specific users. We may use Web Beacons to count visitors to our web pages or to understand how users move through our Service, and we may include Web Beacons in e-mail messages in order to count how many of the messages we sent were actually opened or acted upon. We use Web Beacons to create aggregate statistics about our Service and our marketing campaigns.

2.8 Embedded Scripts: An embedded script is programming code designed to collect information about how you interact with the Service, such as the links you click on. The code is temporarily loaded onto your Device from our web server or a third party service provider, remains active only while you are connected to the Services, and is deactivated or deleted thereafter.

2.9 Browser Fingerprinting: Collection and review of information from your Device, such as, without limitation, your operating system, plug-ins, system fonts and other data, for identification purposes.

2.10 ETag, or entity tag: A feature of the cache in browsers. It is an identifier set by a web server to a specific version of a resource found at a URL. If the content of that resource changes, a new ETag is assigned. Used in this manner ETags are a form of Device Identifier. ETag tracking may generate unique tracking values even where the consumer blocks HTTP, Flash, and/or HTML5 cookies.

2.11 Recognition Technologies: Technologies, including application of statistical probability to data sets, which try to recognize or infer about users and devices (e.g., that a user of multiple devices is the same user).

2.12 FanDuel may also receive information about you from third parties, such as marketing partners, identity verification services, anti-fraud services and other service providers.

3. How FanDuel Uses Your Personal Information

3.1 We use your personal information to operate, maintain, and deliver to you the features and functions of the Service, including, without limitation the following:

3.1.1 providing you with our products and services, including our games;

3.1.2 protecting and managing your account

3.1.3 providing customer support, including resolve disputes, collect fees and troubleshoot issues;

3.1.4 processing and tracking the results of your gambling and other transactions you enter into using the Service;

3.1.5 verifying your identity, including your accounts on the Service;

3.1.6 handling and responding to enquiries;

3.1.7 personalizing your experience of the Service,

3.1.8 notifying you about new features, special events, products and services, or certain third-party products or services that we believe may interest you;

3.1.9 enforcing the legal terms and rules that govern your use of the Service;

3.1.10 manage risk and detect, prevent, and/or remediate fraud or other potentially prohibited or illegal activities; and

3.1.11 investigating issues and protecting the integrity of the Service.

3.2 Where you have provided consent, we may use your information (both personal and non-personal information) to send you marketing and advertising materials, including sending you advertising through various channels, such as direct mail, email, push notifications and display media. We may send you advertising or content regarding our products and services, or products and services we market on behalf of another company, such as a sports team, a sports venue, or other entity.

3.2.1 With your consent, in the event that you win a prize, we may use your name, likeness and other biographical information for promotional or commercial purposes.

3.3 We may use your information to contact you about:

3.3.1 our products and services in which you may be interested unless you have requested otherwise;

3.3.2 newsletters and information for which you have signed up; and

3.3.3 administrative or non-marketing purposes (such as notifying you of significant changes to the Service or for customer service purposes).

3.4 We use your information to improve the quality, structure, and design of our Service and to develop new features, promotions, functions, and services including by storing, tracking, and reviewing user preferences and trends.

3.5 We may also use cookies, clear gifs, log file information, and mobile app information such as device identifiers for purposes such as (a) remembering details so that you do not have to enter it again during your visit or the next time you visit our Service; (b) delivering customized and personalized content and information; (c) measuring the effectiveness of our marketing campaigns; (d) reviewing aggregate metrics such as total number of visitors, pages viewed, etc.; and (e) tracking your entries, submissions, and status in promotions, sweepstakes, and contests. More information about how these technologies are used in the Section below, Third Party Advertising and Analytics.

3.6 We may anonymize, de-identify, or combine your information for legitimate business purposes, including for reporting and research, or advertising. This anonymized and/or aggregated data does not identify you personally.

3.7 We will retain personal information for as long as needed to fulfill these purposes unless applicable law requires us to keep it for a longer period of time. To support security and business continuity for the activities described here, we make backups of certain data, which may be retained for longer than the original data.

4. Transfers and Disclosures to Third Parties

4.1 We may transfer information that we collect or receive from you to our subsidiaries, affiliated companies, agents, or other businesses, or service providers that process your information on our behalf to provide or operate the Service. Our service providers may be based in the U.S., Canada or other foreign jurisdictions. These third parties are given only the information needed to perform their assigned functions. For instance, these entities may have access to your information for purposes including, without limitation billing and accounting, hosting, marketing, promotional and email services, customer and technical support, know-your-client identity verification, responding to access requests, and for the purpose of accepting deposits and paying withdrawals and processing such information on our behalf, and, in each case, may use the information to improve the services they provide to us. Our agreements with these service providers limit the types of information they can use or process and require reasonable efforts to keep your personal information secure.

4.2 If you choose to share information with social media services about your activities on FanDuel by, for example, connecting your social media account to our Service, then FanDuel may share your personal information and information about your use of the Service with such social media sites. Please review the terms and privacy statements of such sites before connecting them to our Service in this way.

4.3 In the event that you win a promotion run by us, we may be required to disclose your name, contact information and information about the prize you win to governmental authorities.

4.4 Where you have consented, we may share your personal information with selected third parties for commercial or marketing use in conjunction with your relationship with FanDuel or within a specific program or feature.

4.5 We may also disclose to third parties different types of your information for targeted online or mobile advertising, as described further in the Section titled “Advertising and Analytics.”

4.6 We may also share personal information in other situations with your consent.

4.7 FanDuel also may disclose personal information that FanDuel reasonably believes is appropriate or necessary to enforce our Terms of Use, take precautions against liability, risk, or harm, investigate and respond to third-party claims or allegations, to respond to court orders or official requests, comply with state and federal regulations, including, without limitation sharing with appropriate tax authorities, protect the security or integrity of our Service, report violations of FanDuel’s eligibility rules to third parties, including employers of individuals affiliated with other daily fantasy sites, and protect the rights, property, or safety of FanDuel, our users or others.

4.8 If FanDuel is involved in a merger, acquisition, sale, bankruptcy, insolvency, reorganization, receivership, assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors’ rights generally, or other change of control, your personal information may be disclosed of your personal information to another entity in connection with that event.

4.9 Your personal information may be disclosed by FanDuel or its service providers in response to a search warrant, another legally valid inquiry, or an order, or to another organization for the purposes of investigating a breach of an agreement or contravention of law or detecting, suppressing or preventing fraud, or otherwise where disclosure is required or permitted by law or regulatory authority, which may include lawful access by U.S. or foreign courts, law enforcement or other government authorities.

5. Your Privacy Choices

5.1 FanDuel will process your personal information in accordance with this Privacy Policy, and as part of that FanDuel gives you certain choices about how we process your personal information. These choices are described below.

5.2 FanDuel will make reasonable efforts to ensure your information is accurate and current. Please update your information through your account whenever it is incomplete, outdated, or changes. You can access and update certain personal information FanDuel holds about you at any time by signing into your account via the Service. You can manage your marketing preferences and whether you would like to receive newsletters in your account. You can also unsubscribe to marketing emails and newsletters by using the unsubscribe option in the communication.

5.3 We may occasionally show display media to you, in a targeted manner, whether through web or mobile browsers or mobile applications. You may opt out of many third parties that support and deliver this type of targeted advertising by visiting http://fanduel-login.ca/, and you may find out more about this type of advertising in the below Section titled “Third Party Advertising and Analytics.” You may opt out of certain tracking for mobile advertising through settings on most smartphones, and you may find out more about these settings through those mobile device platforms, i.e., Google ( here ) and Apple ( here ) . (Please note that these companies may change how these settings operate, the content, availability, or operation of these pages.)

5.4 We may occasionally send push notifications to you to your mobile device. You can disable certain push notifications in the account settings of your FanDuel mobile app. You can also turn off push notifications specific to our Service in the settings on your iOS device, or through the app manager in your Android device.

5.5 Subject to important legal limitations you can submit additional requests through our webform (set out below), such as to request access to, correction or deletion of certain personal information we hold; receive a copy of certain personal information you provided to us in portable form or ask us to share it with a third party; request restrictions on the use of your personal information; object to our use of your personal information; or withdraw consent to use your personal information (which does not affect the legality of any processing that happened before the request becomes effective). You can submit these requests by using our webform .

5.6 For example, you can contact us to opt out of all processing of your personal information for direct marketing purposes (in addition to the unsubscribe option described here ).

5.7 You can contact us as described below with any other concerns, or complaints regarding our data collection, data use or data transfer. You also have a right to file a privacy-related complaint with the relevant privacy regulator, but we invite you to allow us to resolve the matter directly. We will attempt to answer your questions and satisfy your concerns in a timely and complete way.

6. Advertising and Analytics

6.1 We work with several companies that help market our services to you on third-party websites. These companies may collect information about online activities carried out on a specific computer, browser or device over time and across third-party websites or online services to deliver advertising that may be more relevant to you, including advertising about our Services, on sites and apps of third parties. Certain ads appearing on our Service are provided by our advertising partners. Our advertising partners may use cookies and other similar technologies, often together with unique (anonymous) cookie identifiers, to collect data about your activities, interactions, and interests, including the technologies described above. Some of these partners may use mobile device identifiers, such as Apple IDFAs and Google/Android Advertising IDs. This allows the ad companies to recognize your computer or Device when they send you an online or mobile advertisement. In this way, the ad companies may compile information about where you, or others who are using your computer or device, saw their advertisements and measure how you interact with each ad. This information helps ad companies deliver targeted advertisements that may be that may be more relevant to you, both on our Service and elsewhere online. Because these technologies may be used to target ads on our websites and apps, we, or our advertising partners, may use these same technologies and data points (e.g., mobile identifiers, cookie identifiers, location-based data), through our Service or other services, to target advertising (for ourselves or other companies) on other sites or mobile apps. In some cases, these identifiers may be derived from a hashed or encrypted form of personal information such as your email address. We may use this information to measure the performance and effectiveness of our advertising as well, for instance, to evaluate which ads or content users prefer, or which perform best. In addition, sometimes we or an advertising partner may personalize advertising for you across different devices.

Note that because this opt-out method may rely on cookies, you will need to opt out again if you update or change your browser, or delete your cookies. You can also control interest-based advertising on apps on your mobile device with the AppChoices app, available for iOS and Android. Note that opting out will not change the number of ads you see online but the ads may become less relevant to you.

6.3 We also work with third-party analytics companies to collect data on our Service through cookies and other automated methods. In some cases, the third parties mentioned in this section may keep the information they collect in a personally identifiable form. These services allow us to review different reports about how visitors use and interact with with the Services so we can improve our website and understand how people find it and move through it.

7. Data Security

7.1 We are committed to helping protect the security of your personal information. We use various security technologies and procedures to help protect your personal information from unauthorized access, use, or disclosure.

7.2 Although neither we nor any other organization can guarantee the security of information handled online, we maintain appropriate security measures in place to protect your personal information. For example, we may store the personal information you provide on secure computer systems with restricted access that are located in facilities where access is restricted. Additionally, we maintain a Security Incident Response Plan. We will provide notice to you in the event of an incident that materially affects your personal information (a “Data Incident”). We will notify you, iGaming Ontario, and any other applicable regulatory authority about the Data Incident, and we will aid iGaming Ontario and any applicable authorities in the management and handling of the Data Incident.

7.3 To further protect your privacy and security, we may take reasonable steps (such as requesting your password) verifying your identity before giving you profile access or making corrections.

7.4 You should also ensure your password is kept confidential at all times. You are responsible for maintaining the secrecy of your password and account information. 8. Changes and Updates

8.1 This Privacy Policy may be updated periodically and this will be shown by the “Last update posted” date above. Please review this page to stay informed about any changes.
